Protesting your tax judgment in Federal District Court has offsetting advantages. Up until now you have been pleading your case within the IRS system. But Federal District Court judges have no allegiance, no connection with the IRS. They have no special motivation to find for the U.S. government. As a consequence, it is a place where taxpayers may get a better hearing than in Tax Court.

District Court Litigation Requirements

The taxpayer must request the refund from the IRS before commencing district court litigation. The IRS must either deny the request for a refund or take longer than six month to respond. If either of these happens, the taxpayer may begin his or her District Court action.

Unlike the U.S. Tax Court, Federal District Court affords the taxpayer a right to a trial by jury. There are 94 judicial districts nationwide, with at least one in each state.
